BATAVIA, OH (WCPO) – An undocumented immigrant pleaded guilty Friday to raping a 15-year-old.
Jose Tovilla-Lopez, 41, was sentenced to eight years in prison for first-degree rape. He had previously been deported from the U.S. and was in the country illegally, according to Clermont County Assistant Prosecuting Attorney Scott O’Reilly.
He was working in the U.S. using a 69-year-old Arkansas woman’s social security number, O’Reilly said. Tovilla-Lopez was friends with the victim’s family, according to O’Reilly.
He was in their Batavia home at the invitation of the victim’s father and drank “significant amounts of alcohol” and gave alcohol to the underage victim, O’Reilly said. It was then that Tovilla-Lopez raped the victim, who struggled and left visible scratches on him, according to O’Reilly. Tovilla-Lopez fled the scene and was caught later that day in Sharonville.
